Minister of Justice Dr. Bassam Samir Al-Talhouni confirmed that the Council of Ministers approved in its session today the amended system for the use of electronic means in civil judicial procedures for the year 2026, as part of the continuation of developing the justice system and enhancing digital transformation.
Al-Talhouni said that the amendments come in line with the state's directions to modernize the public administration and expand the scope of digital services, by providing a more flexible legal framework for the use of electronic means at various stages of litigation, while maintaining legal guarantees and procedural rights for the parties to the lawsuit.
Al-Talhouni explained that one of the most prominent amendments is the introduction of 'Digital Mail' as a new and approved means within the electronic means in judicial procedures, pointing out that the amendments include adding an independent definition for digital mail, considering it a digital address created for the person and linked to their digital identity, and is relied upon to receive electronic notifications and their attachments in accordance with the provisions of the current legislation.
Al-Talhouni pointed out that the importance of introducing digital mail lies in the transition from the use of multiple electronic means to an official digital address linked to the person's digital identity, which provides a more organized and reliable framework for electronic judicial notification procedures.
He added that the amendments include adopting digital mail as a means of judicial notification, alongside other electronic means, which allows its use to deliver judicial notifications and electronic notices and their related attachments, which contributes to speeding up notification procedures and reducing time and effort and facilitating access of the parties to the lawsuit to the relevant information and documents.
Al-Talhouni confirmed that the amendment is not limited to the technical aspect of digital mail, but also regulates the legal effect of electronic notification, so that the production of notification for its legal effects is linked to the possibility of verifying its conduct based on records and electronic data extracted from the approved systems, which enhances the reliability of notification procedures and provides an electronic basis for verifying its occurrence.
Al-Talhouni pointed out that the amendments expand the scope of electronic means used in judicial procedures, to include interconnection with databases of official entities and digital government platforms, and visual and audio communication means, and any other electronic means approved by the Ministry of Justice in accordance with the provisions of the current legislation.
Al-Talhouni explained that the amendments also regulate the procedures for holding court sessions using electronic means, by setting precise controls for verifying the identity of persons and the integrity of procedures, in order to ensure the proper conduct of the trial and preserve the procedural rights and guarantees of all parties to the lawsuit.
Regarding electronic documents and data, Al-Talhouni confirmed that the amendments enhance the legal validity of electronic data, records, and documents extracted from the systems approved by the Ministry of Justice, provided that their integrity and accuracy can be verified, which supports the reliance on digital documents in judicial work and enhances confidence in electronic procedures and the cancellation of the requirement to submit paper originals of documents submitted electronically to promote reliance on electronic procedures.
In the field of data protection and information security, Al-Talhouni said that the amendments emphasize the need to maintain the security and confidentiality of data in accordance with the current legislation, in line with the requirements of digital transformation and maintaining the integrity of information circulated through electronic systems.
Al-Talhouni added that the amendments include developing the institutional framework overseeing the application of the system, by updating the composition of the competent committee and involving the cybersecurity unit in its work, which enhances the technical and security aspects associated with the use of electronic means in judicial procedures.
Al-Talhouni confirmed that these amendments come within an integrated path to modernize the justice system, and are not limited to introducing new technical tools, but aim to build a comprehensive legal framework that regulates the use of technology in judicial work, ensuring the reliability and legal and technical safety of electronic procedures.
Al-Talhouni said that the Ministry of Justice is committed to developing judicial services and procedures to achieve greater speed and efficiency, facilitate access of citizens and litigants to justice, and reduce the time, effort, and cost associated with procedures, while preserving the rights of litigants and the legal guarantees provided to them
